When Roe V Wade was overturned, abortion laws were placed back in the hands of each individual state. In Ohio, abortion laws and options have quickly changed in the last few months. You might be wondering if you can receive an abortion if you live here in Ohio.
On June 24th 2022, Ohio’s Heartbeat Bill went into effect (it has been temporarily suspended and is under review). The Heartbeat Law in Section 2919.19 through 2919.1910 of Ohio Revised Code prohibits performing or inducing an abortion without first checking for a heartbeat.
In Ohio the following points are also in place:
- A patient must receive counseling and then wait 24 hours before the procedure is provided.
- Medication abortion (the abortion pill) can only be provided using the FDA protocol.
- An ultrasound is needed to determine if there is a fetal heartbeat.
While the Heartbeat Law is suspended, abortion is only legal in Ohio until a fetus is viable (up to 22 weeks gestation). After viability, abortion is available only when necessary to save the life of or prevent serious injury to the mother.
